In-shop Project Warranty

1 General
This company shall not be liable for
anticipated profits, consequential damage of loss of use of any equipment
upon which the Company does work or of
any equipment upon which such equipment is a parts and its sole obligation
shall be to repair or replace any such defective workmanship or materials
and such obligation shall arise only upon written notice within the
warranty period. (Specific warranty period denoted on formal quotation.) In
any event, any such warranty rework or replacement shall not exceed in
amount the original invoice covering the original project or part thereof
subject to any such warranty.
EXCEPT AS EXPRESSLY SET FORTH HEREIN,
WASHINGTON IRON WORKS, INC. MAKES NO WARRANTY, EXPRESS OR IMPLIED AS TO THE
MERCHANTABILITY OF THE EQUIPMENT, PARTS, AND SERVICES SOLD, AND WITH THE
FITNESS OR THE GOODS FOR A PARTICULAR OR PURPOSE
1.1 Repair/Replacement Under warranty
WIW reserves the right of final decision
as to whether a part deemed defective under warranty is to be repaired or
replaced. Also, WIW reserves the option to change designs and/or material
specifications.
1.2 Material
1 2.1 Material
furnished by WIW, subject to its specifications, inspections, etc. shall be
fully covered by the above warranty policy and provisions. Any exceptions
on material quality, below WlW specifications,
shall be reviewed with the customer and any warranty coverage revisions
shall be negotiated on each such exception with the customer.
1.2 2 Material
furnished by the customer will be inspected to customer furnished,
negotiated or WIW specifications, and certification of condition by that
specification made by WIW and reviewed with the customer. This is only as to the acceptability of the material under a particular specification
and/or inspection procedure, and WIW is assuming no material warranty
liability either expressed or implied is such cases.
1.3 Customer Furnished
Specifications/Procedures
Projects Accomplished, totally partially
under these conditions shall not have WIW warranty coverage for failure or lack
of serviceability resulting from faulty specifications and/or procedures.
1.4 Warranty Period (specified on
Quotation)
1.4.1 One year, twelve (12) calendar
months, from date of shipment/completion.
I 4.2 Six (6) calendar months from date
of shipment/completion.
1 4 3 Three (3) calendar months from date
of shipment/completion. 1.5 Extended Warranty Periods
In cases where completed items are kept
in adequate storage by WIW or the customer, the
appropriate warranty period (see 1.4) may be extended for periods up to
twelve (12) months. These warranty extensions must be specifically
negotiated on a project to project basis, between the customer and WIW,
Inc.
2 Custodianship/Transport
2.1 WIW is not
responsible for the damage or loss of the customer parts, equipment etc.9
while on WIW premises, resulting from but not limited to fire, flood
windstorm, stokes, labor disputes, civil disorders, acts of war, acts of
God. or any other condition beyond our control.
7.2 Every
reasonable effort is made to adequately skid/pack parts,
however WIW assumes no responsibility for damage or loss during
transporting, handling or storage off its premises.
3 Special Warranty Provisions which Supersede and Void All the
Above.
3.1 Special provisions may be negotiated
on a project by project basis for special materials, applications, or
situations.

Reserves the right to require that an alignment/general condition
inspection be performed with results acceptable to WIW, prior to crankshaft
installation.

Above.

on a project by project basis for special materials, applications, or
situations.
